Shadow Arena Operational Policy

1. Definition of Operational Policy

- This Operational Policy contains the matters necessary for the service of the Shadow Arena Closed Beta Test (hereinafter referred to as “Beta”).  

- Testers shall be obliged to comply with all provisions stipulated in the Terms of Service and this Operational Policy. If the Tester is in violation of the Terms of Service and/or Operational Policy, the Tester may be subject to restrictions in accordance to the respective provisions.   

- Any matters not mentioned in this Operational Policy shall be governed by the Terms of Service of the Company, and any matters other than that shall be applied and interpreted according to the relevant laws/regulations and general social norms.

- The Company can revise/amend the Operational Policy to provide better Beta services, and will announce revisions/amendments through its website. Testers should become familiarized with any revisions/amendments as the Company shall not be liable, unless otherwise stipulated by the relevant laws/regulations, for any disadvantages caused by misapprehension of any revisions/amendments.

 

2. General Principles of Beta

- The Shadow Arena Beta is a preparatory stage to test the stability of the game before the official service.   

- The Company may adjust the Beta period in order to resolve game errors and conduct testing. In the event of an emergency, the Company may perform periodic server maintenance without giving prior notice.  

- The Company may create, change, remove, and repair (bug patch) the game contents as needed to conduct the Beta. Details will be announced through the website, in-game, and/or other methods. 

- The Company may urgently add, remove, and/or change service contents without prior notification if deemed necessary for operational or technical needs. In this event, details will be announced ex post facto on the website, in-game and/or other methods. 

- The Company shall delete all Beta related data generated by Testers during the Beta after the Beta period is over; this deleted data cannot be recovered/restored. 

 

3. Definition, Role, and Responsibility of GM

- GM stands for "Game Master." GMs shall be in-charge of Testers’ inquiries and requests, which are subject to the procedures and methods set forth in the Operational Policy to ensure the proper operation of the Beta and the Tester’s right to use the Beta.  

- GMs shall not engage in disputes between Testers. However, if the content of the dispute between the Testers is judged to be a serious matter relevant to the operation of the Beta (such as destruction of game order, actual law, violation of public order, etc.), appropriate measures may be taken in accordance to this Operational Policy.

- GMs are strictly prohibited from offering benefits to specific Testers and from providing information about upcoming Shadow Arena services, including updates and events, unless a notice has been disclosed to the general public.

- GMs shall not ask for or change/disclose a Tester’s personal information within the game. However, when requested to provide personal information through a legitimate process by a government agency or a judicial authority etc., the Company may provide personal information to the agency concerned.

 

4. Rights and Obligations of Testers

- Testers shall have the right to use all game content provided in the Shadow Arena Beta. 

- Testers shall be familiarized/understand this Operational Policy, and the Company is not obliged to provide assistance in case of problems or harm caused by the Tester’s failure to observe this Operational Policy.

- Testers shall provide accurate information when registering for the Beta. If false/inaccurate information or information stolen from others is provided, the Tester shall be disqualified (Beta Privileges revoked). In addition, the Tester shall not be entitled to the protection of rights regarding their account information.

- Testers shall report any problems such as bugs or game system errors found while using the Beta to the Company, and shall not disseminate the problems to other Testers or abuse them. In the event the Tester does not report the occurrence of problems such as bugs or game system errors and uses them for the purpose of gaining advantages, the Tester will be disqualified (Beta Privileges revoked) in accordance to the Operational Policy as bringing harm to other Testers.  

- Testers shall be disqualified (Beta Privileges revoked) for circulating and disseminating false information that has not been officially announced by the Company which may confuse other Testers.

- Testers may have their Beta usage restricted or be disqualified (BetaPrivileges revoked) according to each provision stipulated in the [8. Table of Game Restriction Criteria]. Any restrictions imposed at this time will not be carried over to be applied to further Betas and the official launch. However, in the event of the following violations during any Betas henceforth: ‘Client Manipulation’, ‘Use of Illegal Programs/Macros’, and ‘Producing Illegal Programs and Macros’, there may be an additional IP restriction, other than the Beta usage restriction and/or Tester disqualification (Beta privileges revoked), which may be carried over and be applicable to the formal service.  

- The Company uses the following security measures to prevent data loss, theft, breach, alteration, and destruction of Tester’s personal information. However, the Company is not liable if Tester’s personal information is leaked due to the Tester’s negligence such as the Tester losing their device or mishaps outside of the Company’s control.

 

5. Recovery Support Policy

- The Shadow Arena Beta is a preparatory stage to test the stability of the game before the official service. Thus, general recovery and theft-related services shall not be operated.     

- Recovery and compensation will not be supported even if changes in data, such as loss of items or character issues, occur due to system failure or error during the Beta.

 

  1. 6. Website Operation and Posting Policy 
  • - The Company may temporarily suspend website services for the purpose of improving the quality of services and/or maintenance.     
  • - This Posting Policy is an Operational Policy that applies to the forum/bulletin board/posting service of the Shadow Arena website.    
  • - Post/Posting refers to text, image, audio or information (written work, art, or video that is comprised of any of the previous three) in association with the use of the Shadow Arena website services, such as the member forum/bulletin board.       
  • - In order to establish a healthy and safe community culture that is shared by all, posts or content may be moved or deleted without prior notice in accordance with the [7. Table of Restriction Criteria for Inappropriate Website Postings].    
  • - The Terms of Services shall apply to cases not listed in the Posting Policy. If the contents of the Terms of Services differ from the Posting Policy, then the contents of the Posting Policy shall prevail.

  • 7. Table of Restriction Criteria for Inappropriate Website Postings
  • - Inappropriate Postings includes posts with malicious information, inappropriate and conflict-inciting posts, and posts that hamper the community. In the event an act described in the subparagraphs of the “Table of Restriction Criteria for Inappropriate Website Postings” below is identified, the website post/comment will be deleted and posting/comment privileges will be restricted.    
  • - However, if there is significant enough cause, such as considerable harm incurred by the Company/other member or a violation of the relevant laws/regulations, the number of days restricted may be adjusted depending on the severity of the matter (Example: “Posting Restriction (3 Days)” for 1st Violation) or the immediate disqualification as a tester (Beta privileges revoked).

Tester Disqualification (Beta Privileges Revoked)

“Inappropriate Posting” may mean or refer to an act in any of the following subparagraphs. 

   (1) Post with Malicious Information

   • Posts that infringe on the rights (copyright, patent, etc.) of the Company or third parties

   • Posts that harm the reputation of the Company or third parties. 

   • Posts that contain personal information (personal identification information, location, contact, email, etc.)

   • Posts that contain malicious code or induce system failure 

   • Posts that maliciously disseminate false information regarding a particular individual and/or company  

   • Posts that cause confusion or direct/indirect harm to the Company or others by disseminating unconfirmed information

   • Posts that impersonate others, including GMs, bulletin board/forum operators, Company employees, or individuals connected to Black Desert

   • Posts that announce or promote illegal programs, private servers, and etc. 

   • Posts that are related to acts of violating the Terms of Service

   • Posts that are prohibited by other Terms of Service, the policy of each bulletin board/forum, and any relevant laws/regulations

  (2) Inappropriate and Conflict-Inciting Post

   • Posts that cause sexual humiliation, disgust, discomfort or similar to others

   • Posts that are intended to defame or harass others (including personal attack and rumors)

   • Posts that have a strong ideological/religious/political tone or promotes/slanders an ideology/religion/politic 

   • Posts that degrade or discriminate against race, gender, region, nationality, appearance, disability, etc. 

   • Posts that incite violence, wrongdoing and/or gambling

   • Posts that are related to the act of sharing, renting, or trading account information with others

   • Posts that are related to real money trading or item trading

   • Posts that are for advertising (prize giveaway, product advertisement, website/game promotion)

  (3) Community Hampering Post

   • Posts that are unrelated to the nature of the bulletin board/forum or detrimental to the community

   • Posts that are repeatedly uploaded with the same or similar content

   • Posts that are related to games by other companies unrelated to Pearl Abyss 

   

※ Posts that include your or others’ personal information (personal identification information, location, contact, email, etc.) may result in immediate permanent restriction. 

8. Table of Game Restriction Criteria

  • - 3If any act listed in the "Table of Game Restriction Criteria" below is committed, the Tester who made the act shall be held legally liable and be subject to the robust restrictions and penalties imposed by the Company in accordance with the regulations. 
  • - Depending on the severity of the violation made by the Tester — Warnings; Restrictions to the Access of Certain Characters; Restriction to Character Usage; Restriction to Tester Rights (Beta Privileges); etc. may be imposed. 
  • - Other than that, if a Tester’s act is found to be incompatible with relevant laws and regulations, the Company will immediately take strong actions of restrictions and the company can ask for investigation or help to the authorities concerned and judicial authorities, and vice versa, the Company will respond immediately in case there are requests from the authorities concerned and judicial authorities for cooperation.

(1) An act of using the game with multiple Tester privileges (Beta Privileges) or through a systematic and collective manner for the purpose of profit.

(2) An act of violating (contrary to) the law that is identified by an outside agency (organization).

(1) An act of using the computer programs macros, devices, or equipment (hereinafter referred to as "Illegal programs") that disables the technological protection of the service or disrupt the normal operation of the service.
(2) An act where repeated actions similar to the pattern of an illegal program/macro user is identified in the game data.  

(3) An act of using illegal programs that was not authorized by other companies.

(3) An act of degrading, ridiculing, condemning a specific country, nationality, region, politics, prominent figures, gender, religion, race, disability, etc, or sympathizing/inciting an issue of social conflict.
(4) An act of offending others by using insulting language that goes against social norms or claiming an opinion one-sidedly.   

(5) An act of using inappropriate language to incite conflict and/or dispute between Testers.
(6) An act of using ambiguous language for inappropriate purposes.  

(7) An act of making expressions or behavior that may cause fear to other people or may be deemed as a threat to the real life.

(8) An act of making expression or communication that is prohibited in other Terms/Policies with the purpose of causing offense and/or disgust to other people. 

(9) An act of including your/others’ information (personal information, location, contact information, email, etc.) in chat.

(10) An act of using only the initial character/consonant and/or changing the order of characters (such as replacing the front and end of the word) from any of the acts of (1)~(9) 

(11) An act of repeatedly posting the same content or excessive content to interfere with a majority of Testers from using the chat window.   

(12) An act of repeated chat, such as inputting meaningless numbers, to interfere with others from using chat.  

 

※ Chat that includes inappropriate language may result in chatting restrictions without any prior notice.

(1)  An act of using a name that impersonate a GM or an employee of the Company.

(4) An act of using a name that, ridicules, degrades, or condemns a specific country, nationality, region, politics, prominent figures, gender, religion, race, disability, etc
(5) An act of using an anti-social name.

(6) An act of using a name that is suggestive or obscene.
(7) An act of using a name that is intended to infringe or damage the rights of third parties, including honor, portrait rights, and personal information.

(8) An act of using a name that is determined is for the purpose of real money/goods trading of an account and/or item  

(9) An act of using a name that may be confusing to other Testers by being difficult to identify, such as similar characters.   

(10) An act of using a name that is an ambiguous language for a harmful purpose.    

(11) An act of using a name that is prohibited by the naming policy with changed spelling or other characters    

(12) An act of using only the initial character/consonant and/or changing the order of characters (such as replacing the front and end of the name) from any of the acts of (1)~(11) 

 

※ Once a name has been temporarily changed, the Company will not take any separate/particular measures regarding this name.

Customer Support Abuse

(1) An act of making swear words, abusive language, slander, sexual harassment, blackmail, intimidation, and/or reasonable request while using Customer Support.

※ This category was added according to Article 26-2 of the ENFORCEMENT DECREE OF THE OCCUPATIONAL SAFETY AND HEALTH ACT.

※ Testers that violate the same criteria 3 times or more may receive the penalties for the 3rd violation or IP restrictions. In addition, disqualified testers (Beta privileges revoked) that repeatedly commit similar acts may also be restricted by IP.

※ Game information, such as the nickname, may be made public through a notice on the official website for violating the Operational Policy.

※ For the following violations during any Betas henceforth: ‘Client Manipulation’, ‘Use of Illegal Programs/Macros’, and ‘Producing Illegal Programs and Macros’ during any Betas, there may be an additional IP restrictions, other than the Beta usage restriction and/or Tester disqualification (BetaPrivileges revoked), which may be carried over to the formal service and be applicable.  

 

9. Reports and Appeals

  •  Process for Reports and Restrictions 

- The process for the reporting and restriction of acts that violate the Terms of Service and/or Operational Policy are as follows. 

- Act that violates the Terms of Services and/or Operational Policy → (Report) → GM Investigation → (Advance Notice) → Restriction → Appeals/Objections → Notification of Appeal/Objection Result 

- When implementing restrictions, the Company shall provide notification regarding the restriction details and reasons through email, client message, etc. However, certain acts specified in the Terms of Service may be instead notified ex post facto. 

 

  •  Method for Reports and Appeals

- Testers can inquire/request/suggest/report anything regarding the services related to the Shadow Arena Beta and submit any appeals related to restrictions through the website’s Customer Support. 

 

  •  Effect of Appeals

- If the Tester’s appeal is deemed reasonable, the Company shall immediately remove the imposed restriction and restore the Tester’s Beta privileges (Beta access). 

  

 

This Agreement will be effective as of February 11th, 2020.
